A trademark is a unique sign that identifies your goods or services and distinguishes them from those of others. Registering it gives you exclusive legal rights to use it nationwide and the ability to take legal action against infringers.

The overall process typically takes 18–24 months. However, you receive a filing receipt immediately, and can start using the ™ symbol from the date of application. The ® symbol is only permitted after the registration is granted.

Trademarks are classified into 45 classes under the Nice Classification system — Classes 1–34 cover physical goods, and Classes 35–45 cover services. You need to file under the class(es) relevant to your business.

After your trademark is published in the Trademark Journal, there is a 4-month opposition window where third parties can challenge it. Our legal team will file a counter statement and represent you.

Copyright protects original works of authorship including literary works (books, articles, code), artistic works (paintings, photos, logos), musical compositions, sound recordings, and computer software.

Copyright registration is not mandatory in India — protection arises automatically upon creation. However, registration provides prima facie evidence of ownership and makes enforcement easier.

Design registration protects the visual appearance of a product — its shape, configuration, pattern, or composition of colors. It does NOT protect functional features.

A registered design is initially valid for 10 years and can be renewed for a further 5 years, giving a maximum protection of 15 years in India.

A patentable invention must be novel, involve an inventive step (non-obvious), and be industrially applicable. This includes mechanical devices, chemical compounds, and software with technical application.

A Provisional Application establishes your priority date and gives you 12 months to file the Complete Specification. A Complete Application contains full strike-through details and starts the formal examination.
